Terms of Service

This Terms of Service Agreement (the "Agreement") is entered into between EXCEED with Emotional Intelligence, located at 61 Bluegrass Road, Springfield, Manitoba, Canada (hereinafter referred to as the "Coach"), and the individual accessing or using the coaching services (the "Client"), collectively referred to as the "Parties," effective as of the date of the Client's acceptance of these terms. 

1. Services

The Coach agrees to provide coaching services (the "Services") to the Client as described on the Coach's website or as agreed upon in writing between the Parties. The Services may include access to an emotional intelligence assessment tool, one-on-one coaching sessions, and additional resources as specified in the service package booked by the Client.

2. Client Responsibilities

The Client agrees to actively participate in the coaching process, complete any assessments or assignments provided by the Coach in a timely manner, and communicate openly and honestly during coaching sessions. The Client acknowledges that coaching is not a substitute for professional therapy or counseling and agrees to seek appropriate professional help if needed.

3. Fees and Payment

The Client agrees to pay the fees associated with the coaching services as specified on the Coach's website or as agreed upon in writing between the Parties. Payment terms are due upon booking. All payments shall be made in Canadian Dollars to the Coach's designated payment processor.

4. Confidentiality

Both Parties agree to maintain the confidentiality of any information shared during coaching sessions, including but not limited to personal experiences, goals, and challenges. Confidential information shall not be disclosed to any third party without the express consent of the disclosing Party, except as required by law.

5. Intellectual Property

Any materials or resources provided by the Coach during the coaching process, including assessments, exercises, and session recordings, are proprietary and shall remain the intellectual property of the Coach. The Client shall have a non-exclusive, non-transferable license to use such materials solely for personal use in connection with the coaching services.

6. Disclaimer

The Client acknowledges that coaching is a collaborative process and that results may vary based on individual circumstances and commitment to the coaching process. The Coach makes no guarantees regarding specific outcomes or results from the coaching services.

7. Termination

Either Party may terminate this Agreement at any time with written notice to the other Party. Upon termination, the Client shall remain responsible for any fees owed for services rendered up to the date of termination.
